Sheriff Bianco Must Return Ballots

California justices ruled the Riverside County sheriff unlawfully seized 650,000 ballots.

What happened

The California Supreme Court unanimously ruled that Riverside County Sheriff Chad Bianco unlawfully seized more than 650,000 ballots. It ordered him to return the Proposition 50 special-election ballots to county elections officials. State law requires voted ballots to remain under election officials' control, even during a criminal investigation. Bianco acted after a local conservative group claimed a vote-count discrepancy. County election officials said the complaint was unfounded and the real gap was about 100 votes. California Attorney General Rob Bonta sued, arguing Bianco lacked authority and would undermine election confidence. Bianco's lawyers said Bonta could not direct an active sheriff's probe into suspected irregularities. The court rejected that authority argument and barred further ballot handling except to comply.

Left-leaning accounts framed the case as unlawful Republican overreach corrected by the court, not as a valid policing dispute. The Guardian led with Bianco’s party label and the order reversing his ballot seizure. It also cited Patricia Guerrero warning against “unfettered access to ballots” handled outside public procedures. MS NOW described the investigation as built on baseless fraud claims.
