Oil companies asked justices to block Boulder’s climate damages suit before trial.

What happened

The Supreme Court heard arguments over whether federal law bars Boulder’s climate-damages lawsuit from moving forward in state court. The justices did not decide the case after the Oct. 5 hearing. Boulder sued ExxonMobil and Suncor in 2018, alleging their conduct and misleading climate statements helped cause local climate harms. Boulder says the case seeks damages for alleged deception and local costs, not limits on emissions. The companies say the claims would let state law regulate global emissions and energy policy, which they argue federal law controls. The case is one of nearly 30 similar lawsuits nationwide. Justice Samuel Alito recused himself. A ruling is expected by summer 2027.
