What happened
Updated Oct 20, 8:46pm ETGellert Global Group, a New Jersey food importer that brings Canadian cheese into the United States, sued the Trump administration in the U.S. Court of International TradeCourt of International Tradecourt of the United States of America. Trump imposed 50% tariffs on a range of Canadian goods under Section 338 of the Tariff Act of 1930, citing alleged discrimination against U.S. exports. The duties affect about $20 billion in Canadian goods. Section 338 had never previously been used by a president to impose tariffs in its 96-year history. Canada retaliated with counter-tariffs. Gellert says the tariffs could cost it about $40 million a year on cheese imports. Gellert and the Liberty Justice CenterLiberty Justice CenterAmerican non-profit public interest law firm ask the court to block the tariffs, declare them unlawful and order refunds with interest. The case remains pending.
How the left told it
Left-leaning outlets framed the case as a challenge to presidential overreach, while stressing business costs for importers. Al Jazeera cited Gellert Global Group’s argument that Trump bypassed Congress and misused an old law, while the company said the tariffs raised costs and strained supplier ties.
How the right told it
Right-leaning outlets framed the case as a test of tariff authority, with attention to costs and the White House defense. The Washington Times emphasized that the long-dormant Section 338 power had not been tested in court. The New York Post cited Gellert’s $40 million cheese-tariff estimate and the White House claim that Canada discriminates against American exports.
