A Massachusetts judge declared a mistrial in Lindsay Clancy’s murder case after five weeks of testimony and 38 hours of deliberations, when jurors said they could not reach a unanimous verdict. Clancy, 36, is charged with first-degree murder in the strangling deaths of her children Cora, 5, Dawson, 3, and Callan, 8 months. Her lawyers argued she was not criminally responsible because of postpartum psychosis; prosecutors said the killings were deliberate. Prosecutors must now decide whether to retry the case.
Analysis & opinion
Reject insanity defenseMostly Right
Lindsay Clancy should not escape criminal responsibility by invoking postpartum psychosis or an insanity defense. Holding her accountable is presented as the just outcome, and letting that defense prevail would wrongly excuse the killing of her children.
Misplaced sympathyBalanced
Public sympathy for Lindsay Clancy is misguided because it treats a child killer as someone deserving support or admiration. Donations and pro-Clancy outbursts are seen as morally distorted reactions to a grave crime.
